{"id":894,"date":"2020-10-26T15:22:47","date_gmt":"2020-10-26T15:22:47","guid":{"rendered":"https:\/\/www.casinosites.us\/news\/?p=894"},"modified":"2020-10-26T15:22:50","modified_gmt":"2020-10-26T15:22:50","slug":"google-and-apple-hit-with-class-action-for-gambling-apps","status":"publish","type":"post","link":"https:\/\/www.casinosites.us\/news\/google-and-apple-hit-with-class-action-for-gambling-apps\/","title":{"rendered":"Google and Apple Hit with Class Action for Gambling Apps"},"content":{"rendered":"\n<p>Tech giants <strong>Google<\/strong> and <strong>Apple<\/strong> face class-action lawsuits in several states for allegedly promoting illegal gambling by distributing gaming apps which are casino-style gambling apps. The apps allow users to make in-app purchases of app currency to be able to continue to play.<\/p>\n\n\n\n<p>In <strong>Alabama<\/strong>, <a href=\"https:\/\/www.classaction.org\/blog\/mobile-games-sold-through-apple-google-app-stores-violate-alabama-gambling-laws-class-actions-allege\">separate cases filed<\/a> <strong>October 21<\/strong> in federal court claim the tech giants have run afoul of state law in that the games offered through <strong>Apple\u2019s App Store<\/strong> and Google\u2019s Play store are no different than games of chance allowing a player to wager and lose real money.<\/p>\n\n\n\n<p>A complaint filed in the <strong>US District Court for the Southern District of Alabama<\/strong> by state resident Maria Valencia-Torres <a href=\"https:\/\/www.mediapost.com\/publications\/article\/357151\/apple-and-google-sued-over-in-app-purchases-in-gam.html\">alleges both companies of allowing customers<\/a> to purchase games that are \u201cno more no less than casino-style slot machines, casino style table games, and other common gambling games\u201d.<\/p>\n\n\n\n<p>A similar complaint against the two tech giants was also filed in federal court in <strong>Mississippi <\/strong>by Edgar Smith, <strong>October 22<\/strong>, who claimed <strong>Google<\/strong> <a href=\"https:\/\/www.law360.com\/technology\/articles\/1321844\/google-supports-illegal-gambling-through-apps-suit-says\">supports illegal gambling<\/a> through apps. In addition to the complaint in Alabama, three other class- action complaints from state residents of <strong>Tennessee<\/strong>, <strong>Connecticut<\/strong> and <strong>Georgia<\/strong> were filed against Apple.<\/p>\n\n\n\n<p>In <strong>Connecticut<\/strong>, Apple is allegedly accused of promoting, enabling, and profiting from the different types of gambling games it offers through the App Store by plaintiff Karen Workman who spent approximately $3,312.19 across numerous \u201cgambling apps\u201d in the six months before she filed the lawsuit.<\/p>\n\n\n\n<p>Alabama lawsuits argue that even though customers cannot win actual cash, what makes the games supplied by Apple and Google illegal is the fact that users can win more playing time. \u201cAlabama\u2019s gambling statutes make clear that paying money in a game for a chance to win more playing time constitutes illegal gambling under Alabama law.\u201d<\/p>\n\n\n\n<p>The cases further argue that regardless of whether a player can win cash or more playing time, they\u2019re spending money for a chance to win \u201csomething of value\u201d, a concept not limited to gambling in the hopes of winning only cash under state law.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201c\u2026\u2018something of value\u2019 specifically includes \u2018extension of a service entertainment or a privilege of playing at a game or scheme without charge.\u2019 As a matter of law, paying money to get \u2018coins\u2019 one bets hoping to win more \u2018coins\u2019 so as to gain the \u2018privilege of playing at a game or scheme without charge\u2019 is gambling a thing of value under Alabama law.\u201d<\/p><\/blockquote>\n\n\n\n<p>Complaints further allege that Google and Apple are not just bystanders but active promoters of the apps and facilitators of the illegal gambling. According to the lawsuits, Apple and Google wield \u201cdictatorial control\u201d on the in-apps payment methods, on top of the selection process for download.<\/p>\n\n\n\n<p>The series of class-action lawsuits come on the heels of the US Justice Department levying a landmark antitrust action against Google for its unlawfully monopolistic position as the effective \u201cgatekeeper\u201d to the internet, particularly when it comes to search and online advertising. Many already predict Apple will face similar legal action.<\/p>\n\n\n\n<p>In a similar case, <strong>Aristocrat<\/strong> and <strong>Churchill Downs<\/strong> agreed to settle to the amount of <strong>$155 million<\/strong> two claims in Washington related to the social games provided by <strong>Big Fish Games<\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"Tech giants Google and Apple face class-action lawsuits in several states for allegedly promoting illegal gambling by distributing gaming apps which are casino-style gambling apps.
