New Jersey Sets Three-Step Intervention Rules for Online Gambling

Online casinos can now face a more direct obligation to act when customer data points to potentially harmful gambling behavior in New Jersey. The state has recently introduced mandatory behavioral monitoring rules for licensed online casinos and sportsbooks, requiring operators to identify warning signs and intervene through a three-stage process.

Announced by Attorney General Jennifer Davenport, the regulations make New Jersey the first US state to mandate this kind of data-driven assessment and tiered intervention across its expansive online gambling market. The approach shifts responsible gambling beyond offering optional tools and puts greater emphasis on how operators respond when customer activity raises concerns.

The Main Signals

The rules establish specific triggers that require operators to review customer accounts. These include deposits exceeding $10,000 in 24 hours or $100,000 over 90 days, and wagering turnover reaching at least $1 million within 90 days.

Other signals focus on behavior rather than money alone. Repeatedly canceling withdrawal requests, returning to the self-exclusion page without registering, requesting multiple cooling-off periods, or substantially increasing login time can prompt a review. Patterns involving frequent sessions that end with little money remaining or rising bet sizes may also trigger scrutiny. Customers assessed as potentially at risk must be placed on a monitoring list.

The Three Stages of Intervention

The first step is an email explaining available safeguards, including deposit, loss and time limits, cooling-off periods, self-exclusion and account closure.

If concerns persist, customers must watch an educational video before they can resume gambling. The final stage involves direct telephone or video contact, with operators required to provide information about a responsible gambling professional.

Accounts can be suspended after three unsuccessful contact attempts or closed if a gambling problem is confirmed following the third intervention. Referrals to medical services or law enforcement are also permitted when someone poses a danger to themselves or others.

A New Compliance Benchmark?

Governor Mikie Sherrill backed the measures, describing New Jersey’s approach as an effort to develop data-driven safeguards for internet gaming and sports wagering. Davenport also warned operators against trying to evade state requirements.

Luis Del Orbe, executive director of the Council on Compulsive Gambling of New Jersey, welcomed stronger access to support but cautioned that excessive intervention could push some customers toward unregulated platforms.

The rules create a more prescriptive model for responsible gambling compliance, and the challenge now is to identify customers who need help, intervene meaningfully and protect players without driving them toward gambling sites that offer fewer safeguards.
